It is important that you read these Terms and Conditions carefully, they govern our relationship with you. These Terms and Conditions will override any other rights you may have unless this is not permitted by law.

OUR DETAILS

We are Amazon Medical Limited, a company registered in England and Wales at Companies House. Our registered office is c/o Pannell Kerr Forster, Sovereign House, Queen Street, Manchester, M2 5HR and our registered number is 03102071. We operate from Carrington Business Park, Manchester Road, Carrington, Manchester, M31 4XL. Our VAT number is 639071139.

WHO CAN PURCHASE FROM US?

To purchase from us you must (if you are an individual) be over 18 and resident in the United Kingdom. We cannot normally ship to countries outside the United Kingdom, however please contact us if you wish to place an order from another country.

HOW YOUR CONTRACT WITH US IS FORMED

Your order will be placed with us but your payment will be made to Worldpay. It is your responsibility to ensure that your order is correct before submitting it to us. When you submit your order, you are offering to buy the goods at the price set out in the order. We will acknowledge receipt of your order by email. This is not an acceptance of your order. The contract between us is not formed until we confirm that we have accepted your order by sending you an e-mail entitled “Acceptance”. If you discover you have made a mistake with your order please contact sales@amazonmedical.co.uk immediately. Please do this before we confirm your order. We are unable to rectify mistakes after this time, although you may still have the right to cancel as described below.

PAYMENT

The prices indicated on our website do not include delivery charges or taxes such as VAT. Carriage and packing charge will be added automatically to your order before confirmation. All payments must be made in full at the time of placing the order.

DELIVERY

We aim to deliver goods to you within seven days following receipt of the payment in full in respect of the goods from Worldpay, unless you are notified otherwise, but we cannot give an exact delivery date. If the goods that you have ordered are not in stock then the goods will be despatched within seven days of receipt of the goods by Amazon Medical Limited. If we have not delivered the goods within 30 days of submitting your order then you may cancel the contract and we will refund (whether directly or via Worldpay) any money we have received in respect of that order.

DAMAGED OR DEFECTIVE GOODS

We will supply goods that will remain free from defects or damage in materials or caused by workmanship for a period of 12 months (or longer if required by law) from the date of delivery. We will not be liable after that period for defects or damage in goods unless you can prove the damage or defect existed at the time of delivery.

You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible and you must return the goods at your own cost (this cost will be refunded by us if the goods are found to have a defect or damage). If the goods are found to be damaged prior to delivery to you, or defective, we will repair or replace the goods or refund the price paid by you.

These Terms and Conditions do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, fraud or any matter which it would be illegal for us to exclude or to attempt to exclude our liability.

We are only liable to you for foreseeable losses which you suffer as a result of a breach of these Terms and Conditions by us. Our liability to you shall not in any circumstances include any business losses that you may incur, including but not limited to lost data, lost profits or business interruption.

If you are purchasing either wholly or in part for your business or you are a business, our liability to you will be limited to the price paid for the goods.

YOUR RIGHT TO CANCEL

If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you may have a right to cancel the contract and receive a refund from us. You must inform us in writing if you wish to cancel within seven working days, starting on the day after the goods are delivered to you.

If you choose to cancel then you must return the goods to us at your cost and risk and we advise you to ensure the goods are adequately insured during the return journey. You must ensure that you take reasonable care of the goods. If you have not returned the goods when requested by us to do so we can collect the goods from you at your cost.

OTHER IMPORTANT INFORMATION

The formation, existence, construction, performance, validity and all aspects whatsoever of these Terms and Conditions will be governed by the law of England and Wales. The English and Welsh courts will have non-exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms and Conditions or use of the website.
